The Federal Justice of Sinop awaits appeal by the defense of
American pilots Joseph Lepore and Jan Paladino, charged with
involuntary manslaughter in the accident of Gol's Boeing last
September. Federal Judge Murilo Mendes scheduled a hearing with the
two pilots for August 27, in Brazil.
In an interview given to the Long Island Newsday, attorney Joel
Weiss, who represents the Legacy pilots, claimed it unlikely they will
return to Brazil for the hearing. He also stated that the pilots want
to contribute to the case, but that questioning could be done in
several ways, such as videoconferencing or in writing.
To criminal lawyer Claudio Pimentel, there is no legal provision
for courts to accept written or videotaped witness statements.
Pimentel adds that in December 2006, when leaving the country, the
American pilots pledged in writing in the Federal Regional Court to
return for any case proceedings to which they were summoned. "Back
then, they presented no restrictions whatsoever, and are now
suggesting alternative depositions and a safe conduct," the attorney
points out.
Criminal lawyer Claudio Pimentel, who represents Rosane Gutjahr,
the widow of Rolf Gutjahr, killed in the accident of Gol Flight 1907,
was accepted by the Public Prosecutor's Office and by the federal
judge of Sinop, state of Mato Grosso, as assistant to the prosecution
in the trial of the case of the accident involving Gol's Flight 1907,
in September 29, 2006.
