After Federal Judge Murilo Mendes declined to accept Joseph
Lepore's and Jan Paladino's (the American pilots) request to have the
interrogations done in the USA, Joel Weiss, the defense attorney of
the defendants, demonstrated in interviews given to the press, lack of
knowledge of the Brazilian laws.
"Before elaborating any comment, the American lawyer should study
the Brazilian legislation, whose articles 268 to 273 of the Criminal
procedural law code, allow for the participation of the prosecutor's
assistants," explains the Criminal lawyer Claudio Pimentel, who
represents Rosane Gutjhar, the widow of a passenger and member of the
Association of Relatives and Friends of Gol's flight 1907 Victims.
In an official statement, Weiss stated that the pilots are
interested in testifying and telling their stories. According to
Pimentel, if such interest in fact existed, first of all, the American
lawyer should, in observance of the Brazilian laws and the assumed
commitment, have presented his client for the interrogation sessions
and not just send a fax alleging unjustified absence.
Pimentel still considers that it is not surprising the ignorance
of the Brazilian procedural penal laws by the American lawyer when he
stated that, "the Brazilian justice system gave its word to a lawyer
whose goal is to guarantee an award for his client." According to
Pimentel, his client is not worried with the award, but wants justice
to be done.
